Can you please clarify where a SENDCo legally stands if the Head, Governors and/or Academy divert funds from an EHCP so the child has no 1:1 LSA or additional support ?

Paperwork and email trails to make it clear that you have pointed out the irregularity should it be challenged.
It’s a difficult one to answer without all the facts. If the child is still getting all of section F in the EHCP and the LA just happens to be overfunding (unlikely but go with the flow) then legally the school isn’t doing anything wrong. It’s when section F is not being provided it becomes an issue – and if you have secured the LA funding to deliver that then there could be an issue.
